1. Acceptance of Terms
When these Terms apply and who they cover.
By accessing or using 3drake (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms apply to your use of the 3drake Console, 3drake HTTP API, documentation, and any related support services.
If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
2. Description of Service
What 3drake does (and does not do).
3drake is an email gateway / relay API. It helps you send email through third-party email providers such as Gmail (via app password), Outlook (via app password), or custom SMTP servers.
What 3drake does
- Authenticates API requests.
- Routes and relays outbound email to your selected provider using your configuration.
- Applies safety controls (rate limiting, abuse prevention, operational guardrails).
- Provides operational logs and status for troubleshooting and reliability.
What 3drake does NOT do
- 3drake does not originate, control, or determine your email content or recipient lists.
- 3drake does not read or analyze the meaning of your email body content.
- 3drake does not provide inbox access or mailbox scanning functionality.
3. Eligibility & Accounts
Who can use 3drake and what you are responsible for.
- You must be at least 18 years old and have legal authority to use the Service.
- You must have the right to use any email accounts, domains, and credentials you connect to 3drake.
- You are responsible for all activity under your account, including API keys.
- You agree to provide accurate and current information for account administration and billing (if applicable).
Security note: keep your API keys and provider credentials safe. If you believe they are compromised, rotate keys and update sender credentials immediately.
4. User Responsibilities
Your obligations when sending email using 3drake.
You are solely responsible for your use of the Service, including:
- Email content, attachments, and links.
- Recipient lists and consent where required.
- Compliance with applicable laws (anti-spam, consumer protection, privacy) and provider policies.
- Maintaining proper security practices for credentials and API keys.
You acknowledge that delivery outcomes depend on many factors outside of 3drake’s control (recipient mail servers, spam filtering, provider policies, bounces, throttling, or blocks).
5. Prohibited Use
Activities that are not allowed on 3drake.
You may not use the Service to:
- Send spam, unsolicited bulk email, phishing, or deceptive messages.
- Distribute malware, harmful code, or content intended to compromise systems.
- Impersonate others or misrepresent sender identity.
- Violate intellectual property, privacy rights, or applicable laws.
- Probe, scan, or test the vulnerability of the Service, or bypass rate limits or authentication.
- Use the Service in a manner that disrupts, overloads, or harms the Service or other users.
Enforcement: we may suspend or terminate access (with or without notice) if we reasonably believe your use violates these Terms or creates risk.
6. API Keys & Security
Key management and platform security expectations.
- API keys identify and authorize requests. Do not share them publicly.
- You must rotate keys if you suspect compromise or exposure.
- You must use HTTPS for all API calls.
- We may revoke keys that are abused or present a security risk.
Provider credentials: if you connect Gmail/Outlook or custom SMTP, you are responsible for generating and managing app passwords / secrets per provider guidance.
7. Rate Limits & Fair Use
Platform protections for stability and abuse prevention.
To protect the Service and other users, 3drake enforces rate limits, usage quotas, and abuse prevention controls. Limits may vary by plan, endpoint, or usage patterns.
- If you exceed limits, requests may be throttled or temporarily blocked.
- We may adjust limits to maintain platform stability and security.
- Attempting to bypass limits may result in suspension or termination.
8. Service Availability & Changes
Uptime, maintenance, and evolving endpoints.
We aim to provide a reliable service, but we do not guarantee uninterrupted availability. The Service may be impacted by maintenance, upgrades, provider outages, networking issues, or events outside our control.
We may modify, suspend, or discontinue any part of the Service, including endpoints, features, limits, and plans. If changes materially reduce core functionality for paid customers, we will make reasonable efforts to provide notice.
9. Fees & Billing
Paid plans, renewals, and non-payment.
Certain features may require payment. Fees, limits, and plan details are described in the Console or applicable order form.
- By subscribing, you authorize us (or our payment processor) to charge applicable fees.
- Unless stated otherwise, fees are non-refundable.
- If payment is overdue, we may downgrade, suspend, or terminate access to paid features.
Note: taxes may apply depending on your jurisdiction and billing information.
10. Data & Privacy
Where privacy terms live and what is incorporated.
Our data practices are described in the 3drake Privacy Policy. The Privacy Policy is incorporated by reference into these Terms.
If you use 3drake to send email to recipients, you are responsible for any disclosures, consents, and notices required by law.
11. Intellectual Property
Ownership and license to use the Service.
3drake and its licensors own all rights, title, and interest in the Service, including software, APIs, documentation, and branding.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes.
You may not copy, modify, distribute, sell, or lease any part of the Service unless permitted by law or with our written permission.
12. Disclaimer of Warranties
“As is” and “as available.”
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that emails will be delivered or accepted by providers or recipients, or that the Service will be uninterrupted or error-free.
13. Limitation of Liability
Limits on damages to the extent allowed by law.
To the maximum extent permitted by law, 3drake will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our aggregate liability for all claims relating to the Service will not exceed the amount you paid to 3drake for the Service in the twelve (12) months before the event giving rise to the claim.
14. Indemnification
You agree to protect 3drake from certain claims.
You agree to indemnify and hold harmless 3drake and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Your use of the Service.
- Email content, attachments, recipient lists, or your compliance obligations.
- Your violation of these Terms or any applicable law.
- Your infringement or violation of third-party rights.
15. Termination
Ending your access to the Service.
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe:
- You violated these Terms or engaged in prohibited use.
- Your use creates security, legal, or operational risk for 3drake or others.
- We are required to do so by law or by provider requirements.
Upon termination, your right to use the Service will cease. Certain provisions (e.g., limitation of liability, indemnification) will survive termination.
16. Governing Law
Jurisdiction and venue.
These Terms are governed by the laws of Viet Nam, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service will be resolved in competent courts located in Viet Nam, unless otherwise required by law.
